» Commentary by Kris Lazaro (registered Democrat)

Smoking should be banned in all public places, such as restaurants, bathrooms, and any other enclosed areas, but it should not be completely illegal. This author believes in freedom of choice, and while smoking impinges on others' rights to clean air, smokers have the right to light up. It is similar to yelling 'fire' in a crowded theater: One has complete liberty to yell such a phrase, but to yell such a phrase would endanger others, hence it is conventionally unacceptable, though not completely illegal.

This survey shows that only a small fraction of voters agree that smoking should be against the law. This author agrees with this statement conditionally. Smoking should not be illegal, but it should also not impinge on others' rights. They must smoke responsibly, away from others and in designated areas. Government should not be able to control one's right to smoke.
